SECTION 522 Certain Entities that are Forbidden to Be Carried on a Festival (1-4)

סימן תקכב קְצָת דְּבָרִים הָאֲסוּרִים לְטַלְטֵל בְּיוֹם טוֹב וּבוֹ ד' סְעִיפִים:

1 A sightless person and an elderly person may not go out to the public domain or a karmelis [carrying] a cane1 because this is a weekday practice and is [thus] demeaning to the festival.2 [The rationale is that] it is possible for [such a person] to walk without the cane and is only carrying it for [additional] assistance, [to] balance his steps.3

Similarly, a shepherd may not go out carrying his satchel, neither to the public domain nor to a karmelis because this is a weekday practice and is [thus] demeaning to the festival.

א הַסּוּמָאא וְהַזָּקֵןב אֵין יוֹצְאִים בְּמַקֵּל לֹא לִרְשׁוּת הָרַבִּים וְלֹא לְכַרְמְלִית,ג1 מִפְּנֵי שֶׁהוּא דֶּרֶךְ חֹל וְזִלְזוּל לְיוֹם טוֹב,ד2 כֵּיוָן שֶׁאֶפְשָׁר לוֹ לְהַלֵּךְ בְּלֹא מַקֵּל זֶה וְאֵינוֹ נוֹטְלוֹ אֶלָּא לְתַקֵּן וּלְיַשֵּׁר פְּסִיעוֹתָיו.ה3

וְכֵן אֵין הָרוֹעֶה יוֹצֵא בְּתַרְמִילוֹו לֹא לִרְשׁוּת הָרַבִּים וְלֹא לְכַרְמְלִית, מִפְּנֵי שֶׁהוּא דֶּרֶךְ חֹל וְזִלְזוּל לְיוֹם טוֹב.

2 The laws pertaining to an amputee, a person whose tendons of his thighs have withered, and one who is sick on a festival are the same as those that apply on Shabbos, as explained in sec. 301[:12-13].4

ב הַקִּטֵּעַ וּמִי שֶׁנִּכַּוְּצוּ גִּידֵי שׁוֹקָיו וְהַחוֹלֶה – דִּינָם בְּיוֹם טוֹב כְּמוֹ בְּשַׁבָּת,ז כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן ש"א.ח4

3 It is permitted to carry a person out to the public domain5 even though he could walk by himself and he is being carried only so that he will not be pushed by the people in the marketplace, so that his garments will not become dirty, or it is a place where he fears to go on his own lest he fall. Since carrying [such a person] is somewhat for the sake [of the festival] it is permitted to carry him out on the festival, as explained in sec. 518[:1].6

However, it is forbidden to take him out on a chair,7 i.e., he sits in a cathedra8 and people carry him. [This is forbidden] because it is a weekday practice and is demeaning to the festival.2 If, however, he is a person who is needed by many people on the festival, [for they desire] to hear his wisdom or he is going to oversee communal affairs, it is permitted to take him out in [a cathedra]7 even when it is carried on [the bearers’] shoulders, (i.e., people carry [him in a cathedra] on their shoulders in public view). [It is also permitted to carry such a person] in a palanquin. [See the diagrams on the following page.]

ג מֻתָּר לְהוֹצִיא אָדָם לִרְשׁוּת הָרַבִּיםט5 אַף עַל פִּי שֶׁהוּא יָכוֹל לֵילֵךְ בְּעַצְמוֹי וְאֵינוֹ נוֹשְׂאוֹ אֶלָּא כְּדֵי שֶׁלֹּא יִדְחָקוּהוּ בְּנֵי הַשּׁוּק, אוֹ כְּדֵי שֶׁלֹּא יִטַּנְּפוּ בְּגָדָיו,יא אוֹ בְּמָקוֹם שֶׁהוּא מַבְעִית לֵילֵךְ בְּעַצְמוֹ שֶׁלֹּא יִפּוֹל,יב כֵּיוָן שֶׁיֵּשׁ צֹרֶךְ קְצָת בְּהוֹצָאָה זוֹ – מֻתָּר לְהוֹצִיאוֹ בְּיוֹם טוֹב, כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן תקי"ח.יג6

אֲבָל אָסוּר לְהוֹצִיאוֹ עַל הַכִּסֵּא,יד7 דְּהַיְנוּ שֶׁהוּא יוֹשֵׁב בְּקַתֶּדְרָא8 וּבְנֵי אָדָם טוֹעֲנִין אוֹתָהּ, טו מִפְּנֵי שֶׁהוּא דֶּרֶךְ חֹל וְזִלְזוּל לְיוֹם טוֹב. טז, 2

וְאִם הוּא אָדָם שֶׁרַבִּים צְרִיכִים אֵלָיו יז בְּיוֹם טוֹב לִשְׁמוֹעַ חָכְמָתוֹ, יח אוֹ שֶׁהוּא הוֹלֵךְ לְפַקֵּחַ עַל עִסְקֵי רַבִּים יט – מֻתָּר לְהוֹצִיאוֹ בַּכִּסֵּא7 אֲפִלּוּ עַל הַכָּתֵף (פֵּרוּשׁ שֶׁבְּנֵי אָדָם נוֹשְׂאִין הַכִּסֵּא עַל כְּתֵפָם דֶּרֶךְ פַּרְהֶסְיָא כ) וּבְתוֹךְ אַפִּרְיוֹן. כא

4 An animal may not be directed with a staff.9 [This restriction applies] even in a lane in which an eruv has been made, if many people are located there.10 [And it applies] even if one designated the staff on the day before the festival and set it aside for this purpose. [In such an instance,] it is not prohibited to transfer an object from one domain to another,11 nor is [the act] prohibited because of carrying wood (see sec. 502[:8]). Nevertheless, there is a prohibition because of the impression that would be created, [i.e.,] it would appear that [the person] is leading the animal to a distant place to sell it,12 and he must lead it across an extensive distance [to reach that destination], therefore, he needs to direct it with a staff.

ד אֵין מַנְהִיגִין אֶת הַבְּהֵמָה בְּמַקֵּל כב, 9 אֲפִלּוּ בְּתוֹךְ מָבוֹי הַמְעֹרָב אִם רַבִּים מְצוּיִים שָׁם, כג, 10 וַאֲפִלּוּ הִזְמִין הַמַּקֵּל מֵעֶרֶב יוֹם טוֹב וְיִחֲדוֹ לְכָךְ כד שֶׁאֵין כַּאן אִסּוּר לֹא מִשּׁוּם הוֹצָאָה כה, 11 וְלֹא מִשּׁוּם טִלְטוּל עֵצִים כו (עַיֵּן סִמָּן תק"ב כז), מִכָּל מָקוֹם אָסוּר מִפְּנֵי מַרְאִית הָעַיִן, שֶׁנִּרְאֶה כְּמוֹלִיכָהּ לְמָקוֹם רָחוֹק לְמָכְרָהּ שָׁם12 שֶׁהוּא צָרִיךְ לְהַנְהִיגָהּ הַרְבֵּה, כח וּלְכָךְ הוּא מַנְהִיגָהּ בְּמַקֵּל.
