SECTION 521 The Laws Applying to Lowering Produce from one Place to Another on a Festival (1-4)

סימן תקכא דִּין שִׁלְשׁוּל פֵּרוֹת בְּיוֹם טוֹב מִמָּקוֹם לְמָקוֹם וּבוֹ ד' סְעִיפִים:

1 When a person has wheat, barley, or other produce spread out on top of his roof to dry and he sees that it will soon rain, the Sages permitted him to exert himself [more than he normally would] on a festival and cast the produce [into his home] via a skylight1 in the roof,2 because of the financial loss [he would otherwise suffer].3 However, it is forbidden for him to exert himself by carrying it down himself by using a ladder or steps.4 Instead, he should [gather the produce in a container] and lower it with a rope via the skylight, [allowing it] to fall on the ground, thereby avoiding exerting himself excessively.

If his roof does not have a skyklight, he may not take [the produce] to another roof that has a skylight even if [the two roofs] are next to each other and are on the same level,4 one not being higher than the other. Similarly, if the roof that does not have a skylight is surrounded by a guardrail, and there is a window in the guardrail, he may not lower [the produce] through this window with a rope.4 [The rationale is that] lifting [the produce] from the roof to the window involves difficulty [and the Sages] did not permit [a person to undertake] this or similar exertions [on a festival] because of [the possibility of] financial loss.

א מִי שֶׁיֵּשׁ לוֹ חִטִּים וּשְׂעוֹרִים א אוֹ שְׁאָר פֵּרוֹתב שְׁטוּחִים עַל רֹאשׁ גַּגּוֹ לְהִתְיַבֵּשׁ וְרָאָה גְשָׁמִים מְמַשְׁמְשִׁין וּבָאִיםג – מִפְּנֵי הֶפְסֵד מָמוֹנוֹד,3 הִתִּירוּ לוֹ חֲכָמִים לִטְרוֹחַ בְּיוֹם טוֹבה וּלְהַשְׁלִיךְ הַפֵּרוֹת דֶּרֶךְ אֲרֻבָּהו,1 שֶׁבַּגָּג.ז,2 אֲבָל אָסוּר לִטְרוֹחַ וּלְהוֹרִידָם בְּעַצְמוֹ בְּסֻלָּםח אוֹ בְּמַדְרֵגָה,ט,4 אֶלָּא יְשַׁלְשְׁלֵם בְּחֶבֶלי דֶּרֶךְ אֲרֻבָּה וְהֵן נוֹפְלִין לָאָרֶץ, שֶׁאֵין כַּאן טִרְחָא יְתֵרָה.יא

וְאִם אֵין אֲרֻבָּה בְּגַג זֶה – לֹא יוֹלִיכֶנּוּ לְגַג אַחֵר שֶׁיֵּשׁ בּוֹ אֲרֻבָּה,יב אֲפִלּוּ הֵן סְמוּכִין זֶה לְזֶה וְהֵן שָׁוִיןיג,4 שֶׁאֵין הָאֶחָד גָּבוֹהַּ מֵחֲבֵרוֹ.יד וְכֵן אִם גַּג זֶה שֶׁאֵין בּוֹ אֲרֻבָּה הוּא מֻקָּף בְּמַעֲקֶה וְיֵשׁ חַלּוֹן בְּמַעֲקֶה זוֹטו – לֹא יְשַׁלְשְׁלֵם בְּחֶבֶל דֶּרֶךְ זֶה הַחַלּוֹן,טז,4 מִפְּנֵי שֶׁיֵּשׁ טֹרַח לְהַעֲלוֹתָם מִן הַגָּג עַד הַחַלּוֹן,יז וְטֹרַח זֶה וְכַיּוֹצֵא בוֹ לֹא הִתִּירוּ לוֹ מִפְּנֵי הֶפְסֵד מָמוֹנוֹ.

2 When the person is lowering [the produce] via the skylight in the roof, he is permitted to lower even many containers at one time.2 Even if there is a very large amount [of produce] on the roof, he is permitted to remove the entire amount,4 without leaving anything. We are not concerned that [having completely emptied] the roof, he might [then] sweep it and level any cavities on it as we are concerned regarding [similar situations] on Shabbos, as explained in sec. 337[:2.5 The rationale is that the Sages] did not rule as stringently regarding a festival.6

ב כְּשֶׁהוּא מְשַׁלְשֵׁל דֶּרֶךְ אֲרֻבָּה שֶׁבְּאוֹתוֹ הַגָּג – מֻתָּר לוֹ לְשַׁלְשֵׁל אֲפִלּוּ הַרְבֵּה קֻפּוֹתיח בְּבַת אַחַת,2 וַאֲפִלּוּ יֵשׁ בַּגָּג הַרְבֵּה מְאֹד – מֻתָּר לוֹ לְפַנּוֹת אֶת הַכֹּליט,4 שֶׁלֹּא יִשָּׁאֵר בּוֹ מְאוּמָה, וְאֵין חוֹשְׁשִׁין שֶׁמָּא יְכַבֵּד אֶת הַגָּג וְיַשְׁוֶה הַגּוּמוֹת שֶׁבּוֹ כְּמוֹ שֶׁחוֹשְׁשִׁין בְּשַׁבָּת כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן של"ז,כ,5 מִפְּנֵי שֶׁבְּיוֹם טוֹב לֹא הֶחֱמִירוּ כָּל כָּךְ.כא,6

3 It is permitted to cover produce and jugs of wine because of [water] leaking [from a roof].2 One may even cover bricks that are muktzeh because of leaking [water.4 The Sages] permitted [a person] to undertake this slight extra exertion although it is not for the sake of the festival, because of the financial loss he [might otherwise suffer].7
