Affirming a debt. Does the person alleging the debt have to follow the same procedure. In a hypothetical if they both swear someone has to be lying. What is the resolve in such a case and the person found lying. Reply
To Steven The alleged debtor is only required to swear if he denies part of the claim. However, if he denied it completely, he does not swear.
It is assumed that while someone may be willing to lie for financial gain, he would not go as far as swearing falsely--which is considered much more severe than merely saying an untruth.
